Handbook on Money Laundering Identification, Investigation and Prosecution has been published
The State Financial Monitoring Service of Ukraine in order to increase the capacity of Ukrainian prosecutors to lead the pre-trial investigation and conduct public prosecutions in criminal proceedings in money laundering published a Handbook on Money Laundering Identification, Investigation and Prosecution prepared by international experts of the Council of Europe within the framework of the project on “Strengthening measures to counter money laundering and financing of terrorism in Ukraine” (PGG).
This handbook covers key issues regarding methods of laundering, common forms of laundering in Ukraine, provisions of the Ukrainian legislation on production orders, sources of evidence for financial investigations, advantages of parallel financial investigations etc.
The practical issues covered in the handbook, which are related to the application of international standards for the prosecution of money laundering in different jurisdictions (Spain, Netherlands, Belgium), the use of special investigative techniques in the prosecution of money laundering (technical/electronic surveillance, physical surveillance and observation)), practices to enhance the effectiveness of money laundering prosecutions (identifying the targets of the investigations, asset tracing, documentation of circumstantial evidence, and prosecution of money laundering in court), are of particular relevance.
The handbook, in particular, is developed for representatives of the prosecutor's office and pre-trial investigation, but given the practical orientation of the document, it will be useful for employees of reporting and state financial monitoring entities, law enforcement and judicial authorities, namely, in enhancing efficiency while addressing deficiencies, following to the results of the MONEYVAL 5th round of mutual evaluations on Immediate Outcome 7 (ML Investigation and prosecution).
